Selling un-used magic bands?

Due to the mess over magic bands - when we arrived in August we ended up with 15 magic bands! ( we are a family of 5 ) - so we have 10 unused bands of various colours ( and one nighmare before xmas band) -

They where never used but according to the disney website they cannot be passed on - has anyone ever used a 2nd hand band?

If they're brand new and have never been linked to MDE then theres no reason you can't pass them on

They appear to have the numbers against our names - but we never used them - I can de-activate them. Will this enable them to be used by someone else or not?

No, once they've been connected to MDE or assigned to someone you can't re-sell them, even if you deactivate them

Even if deactivated i believe it is still linked to you as you can go back into the MDE app and reactivate basically so can't be assigned to someone else.
Plus it's against WDW policy

No, once they are linked, they are linked. And deactivating them doesn't unlink them; it just makes them useless - no one can use them.

Because they are linked to your account, then they can't be used by anyone else. MagicBands are non-transferable, which means no other guest can use them once they are assigned to someone. I suspect Disney's IT department can unlink them but you'd have to contact Disney and ask.

Let us know if you have any luck with this. We tried to get two reassigned last year as there was a complete mix up because of the CM issuing them - we were picking up AP bands and the CM linked the wrong colours to the APs - and they said it wasn't possible to change. Meant I ended up with two the same colour which was a pain and we didn't spot it til we tried to get in the park and mine wouldn't work.
