Mobile Flying Freehold?

Has anyone come across this when buying a house?
If so, any issues?
I’d never heard of this before and it’s just been mentioned by our solicitor regarding the property we are in the process of buying.

Not when buying personally but I used to work in an estate agents and they can be tricky. Your solicitor should be able to help but it could cause delays as checks are often needed by mortgage companies etc.

A flying freehold is when a part of your house is over another property meaning you dont own the ground below that part.

These can course issues with the purchase an when living in a property if the person who owns the space below you house makes alterations.

Neither had I! There are lots of variations, but a very common one is terraced houses with a shared entry way between them. I’d never even given a thought to it before today.

There is a question on the property information questionnaire that sellers fill in which asks whether any of your property either overhangs or under hangs a neighbouring property. I guess this is what that means? 🤔

It’s just a shared entry that part of the house is over. The whole estate has houses like this that were built in the 70s/80s. Mostly, the side which covers the entry way is a bigger house. I’ve seen lots of houses like this (and lived in one as a child) and never even given it a thought.

We had a floating freehold on an old cottage we used to own. Part of our kitchen was under next doors large bedroom cupboard! Both properties were owned by the church and divided up many years ago when I guess people didn't worry about these things!

It was only a small area but it did mean a bit more hassle with our buyers solicitors, they weren't keen!

I am not entirely sure, and guess my solicitor will know/be finding out, but I would have thought it would be shared ownership and access.
It’s for access to the rear garden and extremely common. I know lots of people who live in terraces like this, but never thought to ask them how it all works.
