This is what we've asked the signwriter to do. On KTTK they told us they're not allowed to fly the US flag so all of theirs actually have a star removed, we'll take a leaf out of their book and have a modified similar house.

They spent their latter years in a retirement village in a flat, my family home growing up has been extended & changed so dramatically I can barely remember what it did look like, it now has a mosque in the grounds!

You have some fantastic creative ideas! Going to sort through the huge bag of photos I have to see if any do show the front of the house as it was.

I would just do it and wouldn't bat an eyelid. Different if you are using it for commercial use or advertisng etc.

The local ice cream van seller has Mickey and Minnie plastered all over his van, and the likelihood of him having permission is near zero. He looks like he needs a good hot bath, his ice creams are overpriced rubbish and even the cones aren't fresh (just thought I would set the scene). Millions of people probably use Disney's copyright without permission and I doubt they have endless amount of people monitoring this and takimg action. Worst case is they will ask you to remove the said Disney picture(s).

Just because "nobody questions it" doesn't necessarily make it right and/or legal. All it means is that Disney (or whoever) isn't going around taking everyone to court. There are lots of commercial enterprises that use Disney characters and images (eg. ice cream vans) and although nobody questions it, it's generally against trademark and copyright law to use it.

If you want to copy an image, photograph or picture then copyright law states that you usually have to get permission from the owner - that applies to non-commercial uses as well. However, there are exceptions - for example, if the resultant picture is a parody or caricature (and clearly intended to be so) then the result is allowed. Or if you want to use the image to review the film or TV show it comes from then that is usually allowed.

The "UP! inspired house" on etsy is probably treading through a legal minefield. They may claim that it's a parody or "transformative use" - but it does sound like they might be potentially copying Pixar's work and could be legally challenged.

Having said that, I doubt Disney's lawyers would ever come across the OP's painting of the UP! house on the side of their boat and therefore it's unlikely they'd ever challenge it. Just like it's unlikely they'd come across MH's local ice-cream van. In the very unlikely event Disney's lawyers did send them a letter, then all that would be required is for them to immediately remove the image.

I did read about Disney lawyers prosecuting a nursery in the UK years ago, because they had Disney characters painted on the windows.

That is probably pretty rare but you never know!

commercial premises using disney art to potentially sell it to customers in publicly-viewable areas? seems like a sensible choice by the lawyers to me...
