When the UK leaves the EU, all EU law automatically becomes UK law. The provisions of EC261/2004 would still apply unless specifically repealed, replaced or amended by Parliament.

Of course, some of the airline interpretations might get interesting if they try to say it no longer applies in this or that situation, but BA operating a flight out of the UK would be in a difficult spot to claim it didn’t apply.

As it stands this would mean that BA flights operating out of the Uk would not be covered. The provisons relate to flights departing/arriving from EU countries. After Brexit this obviously ceases to be the case. So even though the UK would adopt this law it specifically relates to EU flights - the government would need to bring in additional legislation covering UK flights.

So we may lose some compensation rights but at least we'll have blue passports.😂

That’s pretty unlikely, since very little EU law is specifically dedicated to the UK, and so to say it would only apply in EU countries post-Brexit would pretty much defeat the entire point of this aspect of the EU (Withdrawal) Act 2018.

The point of that was to retain direct EU law, or legislation enforcing EC directives, as if it had been made as UK law in the first place. BA will not be off the hook, though I’m sure it would love the opportunity to claim EC261 does not apply. That would last roughly a day of stories in the Daily Mail.

Indeed, I hope people enjoy their French-made blue passports.

We had a 10hr delay with AA once. I pursued compensation via their online contact us email and we got $600 in vouchers.
Ended up using them for flying AA first to Barbados from Miami. The awkward thing redeeming the vouchers was we had to send them to their office in Spain, so sent via tracked delivery.

Hi just to say that although you cannot put a claim in if you make a written complaint you will get vouchers to use with them . We got $800 we have just used them today actually to book for New York next June 🙈😁

They have sent $100 voucher per person (2 people) so not a lot to encourage us to book another flight.
