How can he come after us for non payment of balance ? Its not our fault either if we cant get there ?

I thought the same, have re checked agreement and if you cancel 10 weeks before date of booking you loose deposit.

We lost our villa deposit but booked privately not through HomeAway or other company. We had good communication with our villa owner and the owner allowed us to delay final payment and was prepared to let us move our dates (but unfortunately he couldn’t accommodate us at the time we needed and we are limited when we can travel.) We did have travel insurance in place but I wasn’t willing to pay the balance to then try claim the money back off insurance in case travel insurance wouldn’t pay up. In the end we accepted that we would have to forfeit the deposit. I wasn’t happy about it but I figured that the money I’d lost was insignificant in what the villa owner had lost due to lost rentals. None of us asked to be in this position and it sucks. Sadly OP, it might be hard getting your money back. Hopefully, someone who has booked through HomeAway can come along and offer their experience. We lost the entire cost (£1600) on one of the homes we booked for our March 2020 holiday. Booked direct with the British owner and no refunds as per the agreement! We had travel cover with Boots which I had total confidence in because of the brand and had noticed, when we renewed last year, the clause excluding cover for anything connected with being unable to travel on FOC advice. At the time I thought 'no problem, that won't happen, we're talking about the USA'! As has already been said we're all now a lot wiser (or should be) concerning future holiday bookings.

I know, gutted, not on loss of deposit as already given up on that, but the trip 😞 still always be another time 😊

I think a lot of people will be booking package holidays going forward based on the many posts, newspaper and radio articles where people have lost hundreds maybe thousands of pounds booking direct with an owner.
We were lucky this year as our Dibb villa owner provided a full refund but I will certainly be checking the t&c’s going forward to ensure a refund is definitely offered |

I have just received a reply from Our villa owner and he has has kindly agreed as a gesture of goodwill, to move our dates to next year in light of the current situation.
