Rights regarding a car purchase
Hi DD bought a used car a few weeks ago that has a warranty on it. As she got it home she noticed a strange noise and reported this to the dealership as soon as she got it home.
They have looked at it for a good few days which has involved her and her uncle going backwards and forwards to this place and have been told this week it will need further investigation. She has decided she wants a refund. As since buying it, it’s only been driven to the dealership! They are saying she can’t have a refund without the V5 document being given back to them.The thing is, she didn’t receive this from the DVLA yet after buying it from them and the car is still with them at their premises now.The wait time apparently to probably receive this is around 6 weeks. Is there no way she can receive a refund without this document even though they have the vehicle in their possession and she hasn’t received it from the DVLA after buying it directly from them? Her uncle is saying if that’s their policy there is nothing DD can do. If anyone has any experience or knowledge of such things I’d appreciate hearing it. Thanks 😊 Edited at 11:20 PM. |

I’m surprised it’s taking 6 weeks for the V5.
2 weeks ago I changed the number plate on a car and the new V5 arrived 5 days later . |

Average time currently for v5 is 4-5 days.

Thanks. We still haven’t received it and apparently it was done when she bought the car and we have not received it here. According to their website that’s what it said, she said because of corona. I don’t know what she was looking at then. I’ve told her to call them in the morning to see if it has actually been transferred to her and when it was sent out.

Hi, I picked up my new car last Friday night and received the V5 on Wednesday. Not sure did this helps but gives you an idea of the current processing time.

Doesn’t the dealership notify DVLA when you buy the car of change of ownership? If so, ask the dealer when they sent off the paperwork to the DVLA as that would give you an idea of how much longer you’ve got to wait.
I think a lot of companies and govd departments have got things on their websites about needing longer timescales due to vivid, but are actually now turning things around in less time then the website says. |

The transfer of ownership should have been done electronically by the dealer in front of the customer.
My experience is they do that then swing the PC around so I can immediately tax the car before they release it to me and I drive off.

Thanks for your replies I was under the assumption this was done in front of them as I’m sure that’s what I was actually told However I went on DVLA and went on the vehicle check site to find it was issued 1st August. I’m assuming that’s when it was posted out. So I’ve told DD to ring to confirm this. They had been given a reference number or something to enable her to but her tax and stuff. I’m quite annoyed nobody did this before. The current timeframe you’ve given me is really helpful, thank you

I agree with the above because my V5 came within 3 to 4 working days recently, and as Tom said it can be done online.
I'm surprised they are offering a refund even with the V5 but good if they do. If the car is over 3 years old do an MOT check online as it can show up some interesting things. |

Very poor of the garage not to send the V5 immediately - I would go back and demand a refund as it's their fault you still don't have the V5. When we bought our car recently the garage filled out the transfer of ownership online whilst we were sat there and we had the V5 within a week.
