Thanks, did you have to fill the affidavit form in or did you just sign it?
There is a notary pretty local but they are only open in Monday ☺️

This a a form to certify that you are not a foreign principle.

You need to see a notary public to sign.

If you ask the title company they will give you detail for a U.S. virtual notary that will do it online over a zoom call for you. It’s around $75 so cheaper than seeing a notary in the UK.

We used them recently and it was a good service.

Unfortunately all foreign buyers have to fill this form in now.

It only seams to be one title company that require it. This came up before. All very odd

Agree, but I just purchased direct and Disney required it to be signed as well now. So suspect all the other title comps will follow if they aren’t doing already

I think there was a period of time when the law was newly brought in that it could be waived, but I believe it is compulsory now.

I am surprised the resale agents haven't started offering a virtual notary as standard, would make things so much easier for all involved.

Hey,

Yes, I had to initial the applicable section and sign/ date the affidavit.

The notary then filled in and stamped their section.

If you buy WDW DVC no need to use a notary.

I think if you buy at Aulani I think its required but i'm unsure.

However when selling you need to getone, normally a local one is not enough unless you also get an apostille.

This is what it states on the email;
you will need to sign the Florida Conveyance to Foreign Entities. Florida passed the law on July 1, 2023, statute 692.201-204. Foreign buyer(s) purchasing Florida real estate transaction, cash or finance are required to sign and have notarized the Foreign Affidavit. This is a Florida rule not a title company rule. Our underwriter guidelines require the document to be signed with a notary. This is a requirement by all underwriters for the state of Florida.
I have attached the Affidavit to this email. Please print and sign it in the presence of a local notary or notary equivalent in your country. Once it is signed please scan and email it back to me

We have been let down by the notary local to us so now we are trying to find another one, I have emailed a couple of companies that do it electronically to see if we can get it done that way 🤞🏻

I must of missed an update, take it you got an offer accepted?
I had the same trouble with the notary, couldn’t find any to sign.
I asked our title company if we could sign the affidavit without it being notarised which they were fine with. Might be with an ask.

It’s a strange hybrid situation between two jurisdictions because in the U.K. a solicitor or notary swears an affidavit. However, in the U.S. they require a notary to do that so that is the instruction. It is however properly sworn as an affidavit in our jurisdiction if a solicitor does it.
I suspect it has to be a notary to satisfy their local requirement which has had no regard when this legislation/ rule was written that not everyone signs affidavits like the local jurisdiction.
It may well be if you got a solicitor to do it and send it back it would ‘pass’ as for one thing they would probably be clueless about it, but to be safe best seek out a notary I would say.
It is a pain and another step in the usually easy buying process Brits could have done without, it will be to stop dubious foreign sanctioned nationals (Russian oligarchs etc) investing in things such as the Miami property market with luxury canal and beach side multi million purchases. These people are not going to be trying to buy DVC
I wonder if they are properly looking at those who are already there to see if everything is above board!
