Complicated public liability question
A friend of mine rents a field for her horses and has bought a field shelter for them to put in it. So she owns the shelter but doesn't own the field.
With the recent storms she's a bit worried in case said shelter 'takes off' as many have and perhaps goes far enough to clear the hedge and hit a car or a person She's wondering about her liability? She's asked about public liability for the whole land but nobody will accept her because she doesn't own the land. Is it the landowner's 'fault' if her shelter causes damage? Or hers? Who is responsible if the worst should happen? Even shelters that were well anchored were lost in storm Eunice so nobody could claim it was rickety (which it isn't, it's brand new) |

Would it not be the same principle for those that own their homes but the land is not freehold ?

Try the NFU. They do a land away policy which might be ok for her. If not they might be able to help her.

Maybe ask the landowner to insure and include the premium cost in her rent?

Personally thinking In this case as long as it’s been built and secured properly and gets maintained I wouldn’t worry about it as your friend will have taken all precautions to prevent such issues. Too much blame game these days .

She should have insurance and a tenant of the land.
We rent out land and all liability was with the tenant. We recently freed the land up for sale so when the tenants left we carried our own liability insurance. |
