Divorce solicitors fees- from pot or separate
Hi
at moment we still have joint account etc & all bills are coming from this. When it comes to paying solicitors bills does it come from the 'pot' when house id sold or should each party pay out of their share once house is sold? Reason I am asking is husband is always on phone to his solicitor & I am worried that he is going to run up expensive bill on purpose?

I would say it should come out of your assets once the they are split otherwise one party could be paying the legal costs of the other. My ex and I met our own legal costs (although hers was deferred as she was on legal aid).

Separate!
My ex ran up a Solicitor's bill bordering on £15,000 and I got most of what I asked for in the end anyway! There was no way in a month of Sundays I was going to pay towards that.

Thank you for your advice. Things are really hard & I do feel he is bullying me. We are using collaborative at mo, but I do have reservations about it. His solicitor is seeming to thrive on him phoning her, & she phoning him! He also says his solicitor is going to 'dig'

If you feel bullied into doing something then stop it!
I don't know what Collaborative Law is so can't pass comment on that but don't listen to the snide comments. Divorce is a game of he said, she said and most of it is made up! :angry: Think about yourself and your daughter and not what may make him happy.

When you say you are feeling bullied do you mean in the meetings or at home? Because if at home, unless one of you moves out, whether you go the collaborative method or the traditional route of your solicitors "negotiating", I can't see it changing - unless it is actual bullying in which case tell your solicitor and have it made part of the process because he could end up being made to leave if it continues.
If you mean in the meetings then your solicitor should be doing more to protect you. As for his solicitor digging, that's just part of the process I'm afraid and, if necessary yours should be doing the same. If it has been a long marriage then all assets are in the pot and your legal eagles should be trying their best to do the best for their clients. If you children are still dependents and will be staying with you - as seems likely from what you have written - then you are in a strong position. Edited at 01:02 AM. |

Thanks for the good advice. I have notified my solicitor that I feel bullied & on trial. I have done everything for my family & I will not let him have more than he deserves because it is me who will have to keep a roof over the girls heads!
