Unless there is negligence. A company can never absolve itself from liability down to their negligence.

Most damage caused whilst it was being driven to and from the parking would involve negligence by someone and therefore covered.

Damage caused whilst it was parked may be a different thing altogether unless you could prove it was parked negligently.

This is true for the UK and I think also true for the US but not altogether sure.

This is why I posted as I and I am sure many others didn't know this.

Why don't you email WDW and ask if the valets are insured before scaring everyone? You are paying for the service so some duty of care must be part of the contract.

A few points.

Such a blanket exclusion would almost certainly fail under UK law (not sure about the US).

Disney will almost certainly carry public liability insurance for such issues, I suspect any incident of negligently caused injury or harm would be fought out between insurance companies.

I'd want to check all car hire companies, their policies may not all be the same.

Anyway, many posters here seem quite happy to drive off road with no insurance, so I doubt a little valet parking would scare them!

I'll certainly continue to use valet parking.

Thanks so much for this information. I had no idea and used valet parking at universal in 2012.

Why does pointing out the facts count as scaring?
I didn't refer to any spacific service so not sure why you picked wdw specifically?
I was more thinking of hotels.

Irrespective of whether they are insured or not, would you want to be the intermediary between two us parties (car hire company and valet) trying to sort this out from the uk with the potentially large resulting legal bills? Also, I suspect you would be expected to pay for the car damage while you sort it out with the valet company as the car hire company wouldn't want to be involved as they have a clear contract with you.

I for one won't be using valet parking again.

I'm thinking if a valet damaged the car you would be able to claim against them however, the car hire company would want reimbursing straight away so you could be on a sticky wicket. The costs of hiring a lawyer to sort it all out may also be an issue.

Thank you for bringing it to my attention as I probably wouldn't have thought anything about it

Thanks for the info. One couple who no longer will use valet parking.
Not worth all the hassles of sorting the problem out if anything was to happen.

If you hand over the car and its brought back to you damaged you won't know if the valet damaged it or somebody else shunted the car and drove off. The one thing that will definitely be confirmed is that the keys were handed over to somebody else. I won't be doing this anymore.

I never knew this but always suspected it - so never got Valet Parked even though was sorely tempted at the big Outlets etc - especially after driving around for 30/40 mins looking for a space.

Thanks for posting

You really think a Valet car parking company.. lets say at a shopping mall will agree to any damage ? nah... .. however... they will have insurance to protect their employees in the event of mishap.

The insurance companies should sort it out between each other, however the rental company are within their rights to charge you (the renter) who then seeks a recovery off the insured party.

Rule of thumb... if there not taking photos (manually or automated) of the car upon arriving, they will generally be accepting nothing...

(even if they do take photos.. its for them against you... not with you..)
