Small claims court
Any hints, tips or advice please around taking a retailer to small claims court?
I purchased a sofa and chair in feb. Order was delivered over a month late, and then chair was partially damaged when we finally got the delivery. Further attempts to replace the chair failed (replacements more broken than the original). Agreed a compensation amount with said retailer in Mid July and was told I would receive this within 30 days. Didn’t receive the compensation. So Spoke to them late August and was told they had processed my compensation incorrectly and it would be a further 14 working days before I received it. Still haven’t had it even though the timescale they quoted has been and gone. They have said they are a bit behind with payments, but no indication of when I can expect it. So am looking at where to go from here and wondered about small claims court. Any advice appreciated. TIA Edited at 06:23 PM. |

Citizens Advice has lots of good information.
citizensadvice.uk/la.../small-claims/ I would strongly recommend following the advice about putting your complaint in writing (with proof of postage/receipt) - phone calls are notoriously unreliable sources of evidence. |

I just drafted a letter for a friend in similar circumstances - sent this recorded delivery to their head office - quoting consumer rights and giving them a specific time to respond. She received her money in full 2 days later 👍👍

Easiest thing in the world to take to small claims I did it to get money back from a car dealer after nearly 3 months.
Before you can take them to the court you have to send them a letter of final demand giving them 14 days to pay. There are lots of template letters on google to help with this. After this has expired and they have not paid you can take them to court. Do this via the money claims goverment site. Fill in the details pay the fee ( you get this back when you win). If they still don’t pay after being served that’s when you physically go to court but as long as you have evidence they agreed to pay compensation you will be fine. |

Did you pay with a credit card? That maybe the easiest route.

Just to add my bookkeeper is amazing at recovering money owed. She sends them copies of the completed forms for the small claims court. We always get swift payment.
