Mobile Delayed info urgent - update on post 30 ***

Hi All, our Manchester to Newquay flight is delayed 3 and a half hours at the moment, our plane is stuck in Newquay because of fog so we have to wait for a plane to go to Innsbruck and come back to get us if we go at all what are we entitled to now at the airport, I'm assuming eu261 won't apply?

It might well be applicable to the EU261 rules although the airline will defend this like crazy. It depends on how you interpret the rules and how hard you press the matter.

So firstly you need to be delayed the right amount of time, assuming you are ...


The rules say that they are bound to pay this compensation except when the flight is delayed by circumstances outside of their control.

Now the people in Newquay are caught by that, it's foggy the airline can't help that.

In Manchester it isn't, the only reason you are delayed is because the airline chose to use the currently delayed plane to service your flight, they made that decision - therefore it is in their control (as evidenced by the fact they are choosing to divert another plane to take you on the journey)

You lose nothing by filling out the form either

Under article 9 of EU 261 you should be offered refreshments (and meals if appropriate) if your flight is delayed over 3 hours.

Interesting, but if the aircraft can't take off from Newquay because of fog then I very much doubt that anything will be landing there for the same reason regardless if a substitute aircraft is immediately available in Manchester or not. I think that you may have a fight on your hands.

If the OP was going to newquay that would be quite right, i am reading Innsbruck

The Newquay airport site shows flights as landing and taking off on time. Get screen shots to support your claim - this will help you to counter their fog delay ‘excuse’.
