Thanks for the explanation. I'm just not used to a claims culture. Insurance covers your losses.

Yes it's upsetting for one person of a large party to be taken ill and I'm assuming food poisoning is just a day or so. I wouldn't sue at home so wouldn't think to do it aboard either and didn't realise you could/would.

If that's what people do it's their choice, I just didn't 'get' it 🙄

Shouldn't they be suing the hotel ?

look here - the good old Package Travel, Package Holidays and Package Tours Regulations 1992

Not read the detail, but Presumably its because the holidaymaker's contract is with the tour operator, not the hotel

Thank you again Buryboy for the information and yes the contract is with Thomas Cook so that is who will be making a claim against not the hotel.
Bluenose; this type of food poisoning took more than a week to get over. Antibiotics along with 3 other tablets were prescribed at the same time of treatment. Our relative was put on a IV drip due to dehydration and was in hospital for over 4 hours. The last of the tablets were taken on the day of departure!. No fun taking medication whilst on holiday when you don't normally take medication not to mention only being allowed to eat certain foods eg bread, rice, apples and Turkish yoghurt for the rest of the holiday!
