I am a CAB adviser too and DisneyDaffodil’s advice is spot on. Don’t delay your Mandatory Reconsideration but expect it to be turned down as that is their default position. Your local CAB will probably have a welfare benefits specialist who will be able to support you with an appeal.

So sorry to hear the news, please make sure you do the mandatory reconsideration ASAP. My sister in law, had a similar problem and she was one of the lucky few and it was overturned, so you never no.

It can be overturned at MR and it is a lovely surprise (as a CAB advisor) when the MR is successful. However, as Omega said they generally tend to quickly pass over the MR and uphold the original decision (almost as if they are hoping the claimant will not appeal or maybe I'm being cynical ). This is one of the reasons why the process needs to be started asap as it can take so long to fully resolve.

Once you send your MR back how long does it take for them to get back to you with their decision?

It varies, they have no time limit. It can be between 2 weeks to 12 weeks or so. Although it doesn't usually take 12, 4-6 weeks would be average.

Thanks, its funny we have a month if you want to MR but they dont have a time limit to reply😣

I know, my DD MR on her DLA took 9months!

I had a talk with DS yesterday about this and need for extra budgetting, but tbh it hasnt sunk in. Going to go through his budget with him properly at weekend. Going to CAB next week, unfortunately we cannot make appts its just turn up, so i can only do next tuesday or wednesday. I will draft a response though and get hold of his advocate again. Feel exhausted with this on top of already loads to do with DD rounds of scans and tests coming up.

Chin up, i know what you mean though there is always something.
I think we need compensation for all we go through and it feels like they don't beleive you even when you have doctors letters and your children have been on lots of apt and perhaps been through special schools. Oh how i wish i was lying sometimes they want to ckme and try living our lives. Rant over😉 Hope all goes well for you next week

I have phoned them and requested report, which tbf came the next day, i went to CAB with draft letter, they also gave me a list of guidelines to use in MR. All done now and ready to send off now. Such a worry and strain on everything. Nothing was declared about assessor being known to DS, but it was used against him as he "engaged" with the assessor, so didnt have problems with strangers! We will see what happens!
