Dla stopped

Ds 12 has ADHD, Asperger’s,dyspraxia and other sensory issues and has been eligible for dla since 2016. Renewal was sent off 6 weeks ago and we got confirmed amount for care component but they took the mobility part off him (low rate)
My husband put in for mandatory reconsideration and today we received a letter to say he is now entitled to nothing not even the care component. According to the letter it all states following a phone call to the school etc ds has no real issues and functions well!
Okay so he’s medicated at school he even has a top up of medication at lunch time to get him through the day! Of course we didn’t get the letter till we got home and rang at 6pm but nobody there that could help us and the lady has put a note on forna decision maker to call us back next week and of course it’s a bank holiday and I feel physically sick 😩
Ds needs an adult around all the time we never leave him alone as his behaviour is so unpredictable he still gets taken to and from school and doesn’t go out with friends as he needs adult supervision etc I still shower him wash his hair brush his teeth as his sensory issues make it impossible for him to do this unaided as he just wouldn’t do it etc I’m sure I don’t need to explain as I’m not the only one with a child with these diagnosis
What will we do will we have to appeal or will a decision maker be able to overturn this decision?
Any advice much appreciated

I think you will have to go for appeal now if you have already done a mr. Ive heard this happening a lot. Start gsthering some extra evidence.

Sorry to hear that.I would suggest going to appeal and gather as much evidence as possible of the extra help he needs every day from school/medical professionals,I have heard that a lot of the decisions are overturned at appeal although appreciate that doesn't help right now.best of luck

I sent so much stuff in for the renewal which was everything I had 🙈 even sent the stuff with the extra medication for lunchtime due to morning meds wearing off by lunch time now he is bigger 😩

I would agree with Amanda and say you need to go to appeal, we've just renewed my daughters DLA and thank god its continued because that money funds so many activities that keep her focused and are good for her mobility issues and I would've fought for that for her. I speak to no end of people who have had to battle for what's right for their child and a lot of the time school has played a part in it, I think because a lot of children are medicated during school hours they don't always see how our kids can be or in my daughters case she has autism and gets routine from school so functions well a lot of the time there. School are often contacted and I suppose they are being honest and saying a lot of the time our children function well, but they only see our kids a certain amount of time and don't usually see the extra support, breakdowns, meltdowns etc etc. Contact CAB a lot have staff dedicated to help with appeals nowadays too.
It's no use me saying don't stress over this because I know I would, contact CAB Tuesday, start keeping a diary of your child day to day... I sent a two week diary in with my dla claim, CAB advised me to do that, hopefully an appeal will get the right outcome xx
Does your son do any out of school activities? My daughter does swimming, brownies, youth club and I asked them to write a letter about her for her dla claim too things like that might help

It appears that they’ve stopped the care element even though the MR was only for the mobility part?
When she rang the woman said we were sent a letter on 5th April stating the money has stopped but we only got a letter on the 12th stating new award for 2 years with the amounts on? So I’m very confused the woman apparently said something isn’t right as it didn’t look right at her end either 🙈 going to spend all weekend worrying about this

I am so sorry you have had this happen, especially as you say, on a Bank Holiday as you cannot move forward with starting your appeal until Tuesday.

Please get help with this, CAB and many charities can help with the appeal. But go asap, Tuesday preferably, as you have a month from the date of the letter to start the appeal. It can seem complicated but CAB advisers are used to the forms and have a very high success rate on appeals for PIP, DLA appeals.

Meanwhile, try to get any letters from specialists or GPs with health details, list of medication, recent hospital appointments etc together. Also, make a list of exactly everything your ds needs help with on a day to day basis as this is the most important part, they need to know how illnesses affects the claimant on a day to day basis. Please try to stress too much, easier said than done I realise, but help is there for you with this. This link may help:

Did you put all this on the form? Sounds like a clear case for DLA.

Google for DLA appeal process and good luck sorting it out

Yes it’s all in the form along with evidence from his consultant adhd nurse and the schools senco I’m not sure how I’m going to explain to my son that all his extra activities will have to stop as he’s having piano lessons 2 times a week private swimming lessons as he still can’t swim unaided or ride a bike etc 🙈 I can’t afford the £60 a week he has on activities without this money as dh only works part time so that he can take and collect ds from school. All this after they spoke to the school and they say he is fine? And to think his junior school said there were no issues for five years u TIL they got the asd/adhd questionnaire and they had to answer yes to most of the questions 🙈

I even put on the form that I have to wake him up at 7am to start the getting ready for school process as he needs constant motivation to do simple tasks like get dressed I can’t leave him to do it otherwise he will be late or not even get there 🙈
My heart says it will all be sorted eventually but in the mean time I’m going to have to cancel his extra activities as I simply can’t afford to pay for them withrout the money and this is going to set him back and it’s half term fantastic 🙈
