On the claim form she would have had to fill in details of her car including the MOT date before the claim would be considered.
I imagine a lot of the costs will be things like hire car etc |

If it was me, I would put a letter/email together to explain the circumstances of why she forgot about the MOT and her current role/ stress/ COVID-19 and make sure it goes to somebody important at the insurer (Claims manager)
I have worked in Insurance for years and we can be flexible at times and these are very special circumstances. |

Another good site is Pepipoo although most of the the cases are speeding related they will offer factual advice on other motoring related issues.

just looked at my cover and it doesn't clearly state that not having an MOT will make the insurance null and void.
It just mentions that you must comply (with lots of things) to have the full protection An MOT in this instance would have resulted in the same claim as the car was parked at the time.

I think your daughter needs legal advice rather than questioning on here. I really hope she has a better outcome she must be so worried.
It is probably about 20 years ago but we had a car accident, our car was a write off. We then realised that our car had needed it’s first MOT a short while before. The insurance company reduced our payout by 10% |

Reading this makes me realise how lucky my boyfriend was, his car was written off whilst parked outside the house and after he rang insurance he realised his tax was out of date. Luckily the insurers didn’t mention it and paid out thankgod!

Is she claiming through her own insurer or the 3rd party?
Who is the insurer as not having an MOT does not invalidate the insure and certainly does not let the 3rd party insurer off the hook. What can happen is the 3rd party insurer reduces the valuation as the vehicle can be claimed to be not roadworthy, however if the MOT has been done now then that is not the case. You can be reported and prosecuted for driving with no MOT but that is a separate offence. |

The lack of an MOT does not necessarily invalidate her own insurance, it depends. However this is not her own insurance but is the other party’s insurance anyway? I do not find it credible that the other insurer can wriggle out of an at fault claim because of this.
