Not true on any indemnity policy I have seen. All you have to do is be able to meet the requirements of the policy most of which mean the works have to be a certain period ago and no contact with the local authority. These policies are designed for known risks (I.e where you know there is a breach).

In my experience, contact has generally been made with the local authority as part of the conveyancing process to establish whether certification is available, and has generally been confirmed by them as not obtained before most conveyancing solicitors try to sell policies.

I am not a residential conveyancer as I deal with commercial real estate but surprised that when a conveyancer asks a question about FENSA they don’t warn the seller not to approach the authority as this would prejudice the ability to get insurance, this is especially true as FENSA can be checked by address without going anywhere near a local authority. Especially at the moment regularising the position is unlikely to be a quick option given limited capacity in most local authority teams, whereas insurance (subject to conditions is all but instantaneous) and despite the reference to solicitors selling a policy this is a pure pass through of cost.

If your installer is a fensa registered installer, just ask him to register them. When we moved house typically our boiler installer and window installer had forgotten to register them. They both then did it and I got the certificates in a few days
