Bail advice please

My daughters partner is on bail for domestic violence against her, his bail forbids him contacting her...
He’s now sent her an advent calendar through Amazon... he’s never bought her one before... and she’s seen he’s bought 2 books on parenting and 1 self help book...
This I think is manipulating her... but is it a breach of his bail...

Yes his bail should say’ must not have any direct or indirect contact‘. I do not know the details of the case obviously but the action would appear to be an attempt at control.
She should report it .

I would say it is a breach. It's not direct but indirect and both are normally forbidden

I would advise your Daughter to contact the Police Officer who is dealing with her case as he/she can check exactly what the conditions are. Under no circumstances should she contact him about the Card even if its to say don't send me any more. keep it clean so there can't be any ramifications against her.

Sending her an advent calendar I would say is a form of contact (not a serious one as such - compared to contacting her to make threats etc).

Buying books for himself on Amazon would not be a breach of bail (she actually went into Amazon to look at what he had bought). It would be wise that she cancelled the joint amazon membership and got her own.

I know someone who had a non molestation order against a violent partner

In her order he’s not allowed to make any contact directly or indirectly, so he can’t get others to call on his behalf , send items etc ..

The bail order will likely have similar conditions, so she needs to tell her solicitor and the Police dealing with her case

Reality is though I can’t imagine much will be done he might just get a warning .

Cancel the joint Amazon account too .

Definitely report it officially, that must be very upsetting, I wonder if you can contact Amazon and put a stop to it from that point too (which avoids contacting him)? I'm so sorry your daughter and you are going through this.

I was a career CID Officer until retirement.

Simple answer.. yes, absolutely. ‘Not to have any contact directly or indirectly’. Whilst he could argue about the books, the advent calendar can only be a calculated act.

This should be reported to the Police immediately and I am guessing that an arrest for breach of bail conditions will follow in short order, followed by an application for a remand.

I do not know the detail of the actual assault, but this breach is potentially more serious than the original offence, whether it be Court or Police bail.
