Thanks all, I’d rather go honestly as lying doesn’t sit comfortably with me, I’m not so worried about references, & there’s really nothing to hand over, my job is reactive.

I haven’t asked yet about shortening, was interested to see if others had & if they had it agreed.

I’ll give HR a call & see if I can get an agreement.

Nurse, bank holidays are meaningless! I do at least have annual leave coming up

This is the minimum legal notice that both you and your employer are required to give.

Your employer should give you:

one week's notice if you have been employed continuously for one month or more, but less than two years
two weeks' notice if you have been employed continuously for two years.
You should also be given an additional week's notice for each further complete year of continuous employment (to a maximum of 12 weeks).

If you have worked with your employer for at least one month, you should give them at least one week's notice. If you have been employed for less than one month, you should give reasonable notice.

Could you suggest you would be happy to do your present role on the bank at times suitable to you but at least they would have some cover?

It is most unlikely you will end up in court for breach of contract, employers won't waste their time. However you will damage your professional reputation.

I have been in the workforce a long time and have had two people leave without working their contracted notice, I have a very poor opinion of both of them and so do most others. I would not give either of them a reference, or if I did, it would be to say how they left in breach of contract.

Your notice period works both ways, it benefits you if there is a redundancy situation for example. The only thing I would do, is look to negotiate a shorter notice period. But otherwise, no, I meet my obligations.

I think your doing the best thing by contacting HR to be honest to see if there is any room for negotiation. If not then then I would grit my teeth and continue to the end. When I left my last nursing post I thankfully had a copy of my contract which clearly stated 4 weeks. The manager tried to tell me it was 12 weeks until I produced the bit of paper.

I have been told on several occasions that a notice period is almost un-enforceable. Definitely contact HR as it's not really in anyones benefit for a member of staff to be there that doesn't want to be there.

I’m about to leave my job this Friday woo. I had a 3 month notice period and negotiated it down to 2 months. To be honest it was hard work getting it down to 2 and this last month has been a waste of time as I’ve hardly had any work to do (and they aren’t replacing me so it’s not a recruitment issue). If your manager isn’t open to having that conversation then I’d definitely have it directly with HR. I wish I’d pushed for 6 weeks maximum really!

Best option is to go on gardening leave - Conflict of interest between current role and new job - thats the simple way..

Though if the role is not if this nature, it could be tricky.. however, any role which requires 12 weeks notice i would expect would be a very dependant role.

Managing it via false medical leave or just by No Show's is not the professional approach nor advisable.

People advising the OP to just go on sick or dont go back is just downright reckless.

Never burn bridges.
