Mobile United cancelled flights on a package

Hi, United has just cancelled my flights which were booked as part of a package (we were due to go on April 3rd) does anybody know whether ATOL would cover this as a supplier failure?

Supplier failure is when the company goes bust (like Thomas Cook, Flybe etc.) so that doesn't apply in this case.

What does your package provider say?

The last time I spoke to them was Friday and they were adamant that they would not refund only rebook. The Package Travel Regulations clearly states that if the foreign and commonwealth office advise against all but essential travel then I would be entitled to a refund. But the tour operator will not budge unless the airline (United) refunds them. United’s stance on this is that they will issue a credit to go towards another booking and will only refund if the credit is not used after a year! The tour operator is saying that I must go through the travel insurance and my travel insurance is telling me that the operator must refund because of the package regulations. I won’t name and shame the operator yet as you never know they may change stance now the flights have been cancelled cancelled by the airline.

Your contract is with the tour operator. It is irrelevant whether they get their money back from the airline, they are no longer able to fulfil their part of the contract. I'm going to caveat that with saying, you need to read your terms and conditions of booking, but that's the principle.

Did you pay by credit card?
If so, contact them as they are being very helpful in situations like this.
