Help with Form W-8BEN from DVC

Received a letter along with the W-8BEN form. The letter states that DVD was notified by IRS that they do not have accurate US Taxpayer Identification Number on file for us.

The letter tells us if we are not American to complete the form leaving the box for the TIN blank.

I am totally confused by Part II of the form - Claim of Tax Treaty Benefits. Does anyone know if I have to complete that section? It mentions see instructions but I didn't get any.

Has anyone completed one of these forms and if so did you do it at time of purchase or was it sent to you a few years later?

Hi

You fill it in with name and address- make sure you put united kingdom not UK, then you put united kingdom in part 9- as the UK has an agreement with the USA that means you will only be taxed in one country- in this case the UK..

I've done this yearly for all my shares I hold in USA with no issues. I get paid my dividends less a 10% holding tax - which is the same 10% that the UK would charge on dividends

Am not sure why DVC would need this form mind as its not an investment.

Yes I couldn't understand why DVC want this form but they say the IRS insist it must be on file and has to be received by 1st December. We purchased our points in 2014 through Disney so just seems strange they are asking for this now.

Did you finance through DVC? That could be why as the interest is tax deductible in USA I think. Won't affect you though they just need the form on file to prove to the IRS that you are not a USA resident and pay tax in the UK, that's the way I understand it.

We had taken Disney finance when we purchased in 2014 but paid it all off within 7 or 8 months.

As they need to have the form by 1st December I was thinking of just taking it back with me in November, especially as the form was quite wet when we got it in the post, so should be easier to get another one if they think it is too badly damaged.

You can google the form number and it takes you to the IRS where you can download a copy and even type your details in before you print it. Its a standard form.

Hi, I’ve just received this form in the post. Does anyone know what you put in the box foreign tax identifying number? Is it my tax code for the UK.
As above poster has said there are no instructions with the form even though each question says see instructions!
