TUI flight only cancellation

Hi, have any Dibbers had a flight only cancelled by TUI?
Doesn’t seem to be any mention on their site regarding flight only, so unsure if they offer refund or voucher.
Thanks in advance

Yes I have. Flight was 13th April and i phoned a few days before and they sent me a cancellation email detailing my refund. The email states it will take 4 weeks to receive the refund, I am still waiting. I realise that have an enormous backlog, and when I phoned again on Friday, they said it would take another 3-4 weeks.

Under EC Reg 261/2004 upon cancellation the duty is to refund in 7 days on a flight only.

That becomes part of your contract.

At the point of 7 days, the credit card company become jointly and severally liable for breach of contract under S75 Consumer Credit Act.

You can sue the credit card company in small claims if necessary for the money on Moneyclaim Online.

But they don’t want to be jointly and severally liable under S75, they’d much rather do a chargeback against the merchant and simply take the money off them.

So don’t mess about waiting for refunds etc any more. If you paid on credit card contact your credit card co and say you want to proceed immediately with a charge back and supply the proof of cancellation and you chasing for the money.

If CCC are dragging feet giving erroneous messages such as you need to wait, make it clear you need a supervisor to understand you will be going now along the S75 route and doing a FOS complaint: Hopefully that will get them moving. Ask them if they want to nominate solicitors to accept service of the summons if you hit a brick wall.

Most CCCs are progressing with chargebacks. Once accepted expect it to take 3-4 weeks to sort at the top end, some credit the money instantaneously subject to merchant supplying counter evidence.

Thanks for your reply.
Wasn’t sure if I had to contact them or they contacted me once the flight had been cancelled.

Thank you for your informative response.
I now have a better idea of how to address this.
Thank you

Hi
I’ve been waiting 6 weeks now for refund carnival cruise..
Informed credit card 4 weeks ago...not heard anything from credit card .phoned them last week credit card said too busy not looked at claim yet due to back log...and expected to look at it in another 2 weeks...
What would you do now?
I’m also owed £800 from Tui...they have told me 4 weeks been only 1 week so far...

We were due to fly on the 16th May, we’ve contacted our cc for a refund albeit still waiting. TUI emailed us probably about 10 days before our flight to cancel.

Not interested in a voucher as unlikely to travel with TUI again.

Good luck all
