Sorry under current employment law if you have not been with your current employer for more than 2 years you have less employment rights making it easier to release someone.

As he was on his probationary period all the employer has done what is required and gave him a meeting within a 10 week period after that if they feel changes are not met they can release him.

Sorry but current employment law is not on your sons side. There sadly is nothing you can do.

Sorry but current employment law is not on your sons side. There sadly is nothing you can do.
I know what you’re saying is true, and I’m not expecting an awful lot to come of this. But they have not followed their own procedures that are set out in the contract of employment. They never informed him that his probationary period was being extended to 16 weeks, so he is effectively now a permanent employee. He has been there 15 weeks now. Permanent employees have more rights in their contract. Things like being informed of meetings in advance, opportunities to have further training to improve. They have just ignored all of their own rules and ignored the rights that their contract gives him.
I know he is probably not going to get his job back (would he even want it back?) But I feel like they have treated him very poorly and should at least be told that.

From your son’s point of view there isn’t a lot you can do, quite a few youngsters get treated poorly in part time jobs.

However, from the sounds of it there’s food prep involved and if you think this isn’t being carried out correctly can you advise the Food Standards Agency about company practice?

your son had a job at a place you left because of lack of training etc then you are suprised at the lack of training your son got ?

apologies if ive misread this?

but if so surely you arnet all that surprised

as for you son sorry for this but best is to just move on as others have said he has legally next to no rights from an employment law standpoint

I see what you’re saying but if we all ignore it then how are things supposed to change? I stayed for quite a while longer than I should have because I wanted to see things change (they weren’t always that way). The negativity and bad feelings were dragging me down so I sadly left.
I suppose I was hoping that things might get better there. I also hoped that my son could just go in, do his job and not get involved in any drama. It’s such a shame it hasn’t panned out that way.
He’s disappointed and feeling rubbish and rejected but it is a life lesson. We talked earlier and he agreed with me when I said that appealing this and standing up for himself will also be a valuable lesson. So he is taking it further and I will support him with that.

At the 10 weeks mark was when they had a meeting with your son which is legally the point when his probation became extended. As a result he is not classed as a full employee.

Even if your son was classed as a full employee as he has been with the the company less than 2 years it is still relatively easy to release someone from employment as he will have reduced rights.

At the end of the day the company knows this and many exploit this to there advantage often for the wrong reasons. Legally the company have done nothing wrong and well within there rights to walk up to your son at the start of the shift and say it is his last day.

As much as what they did is wrong there is nothing you can do about it. As someone else has said in the thread he is only a 17 year old there will be others which is terrible way to treat people.

I had considered this on many occasions when I worked there but I never did it. Mainly because ‘on paper’ they’re doing everything they should. Maybe I’m expecting too much? But to be honest the high standards I had where instilled in me by the company when I joined years ago (in the good old days!)

Yes he will be paid. Obviously we will need to check his wages when they come in at the end of the month, just to make sure.
