If you want to make money out of someone else's copyrighted material you normally have to come to an agreement with them. This may involve obtaining and/or purchasing a license to use their material.

This is my opinion - so please don't sue me

If you lifted a picture (example) from the disney web site and used that "as is" then they could potentially sue you. I believe Disney will at first ask you to desist before calling in the lawyers for repeated action.

If you drew your own design which obviously wasn't perfect you may get away with it.

I must stress I am not a lawyer!

What I meant BB was, if you put your pic up on Facebook making the image avl to the whole world and I copy that, this is a breach of copyright.

However if I make no money out of that breach, the damage in civil law can be very hard to quantify?

I know they have shut down etsy shops that have done similar. Obviously there is a vast scale difference, but I guess it depends how accurately disney they are?

I dont know the answer to that. If I did I would have become an IP lawyer and retired years ago.

Hmm I wonder if I paid for some Disney pictures, say from the Disney store and used them in a decoupage and then sold them if it would be breaking the copyright? It is all very confusing and something I keep clear of.

Yes that's technically in breach of copyright. You basically need a licence from the copyright holder, Disney, so when you see Disney Vans shoes, primark clothes etc, the companies have come to an agreement (financial I imagine!) Disney do quite fiercely defend their copyright, but when you think of all the millions of sellers on the likes of ebay, facebook, etsy etc, it would be impossible to police entirely.

A while ago a friend of mine wanted to get some fabric printed for a dress, which had as it's focus a picture of Walt & Mickey statue in front of the Castle. Disney were helpful but said I needed to get permission from the original photographer. It took me some months to eventually track him down, but did do it. He was happy for us to use the picture without charge as long as we sent him a pic of the finished dress (which was fab by the way). Disney itself can be a lot more difficult to deal with when it comes to using their material.
