Employment rights - Discrimination?
Hi
I work for a large organisation , which covers a whole county. A very long and complicated issue which I can't say too much about on a public forum( tho could discuss in private). My query is, is there such a thing as discrimination due to the location of where you work. Ie you work in one town but have been treated less favourably than a colleague in a different town. The work issues would be the same, the role is the same, the work is the same. It is more involved than that but I just can't say too much or it'd give away who I work for. Thank you

There are nine protected characteristics in employment law, meaning that you cannot be discriminated due to having one of these characteristics. The characteristics will not include working in a different town.
The protected characteristics are: gender, age, pregnancy, disability, race, religion, marital status, sexual orientation, gender reassignment. So no, discrimination is probably not the first avenue to explore here. With more information, there could of course be other routes for somebody who believes they are being treated unfairly. |

I dont think there is such a thing. Even if something appears to be identical that doesnt necessarily mean it is. I work for a huge organisation that is cross jurisdictional and cross country. The role I do is on paper the same as my colleague in Newcastle but I am sure there are some things that are very different due to circumstances or dynamics.
If you feel you been treated unfairly I would discuss with the managed first and give examples of why. Failing that there may be a grievance process that you can appeal to but discrimination on geography isnt something that exists. |

No such thing I’m afraid when it comes to your location of work.
However if say 2 colleagues are expected to achieve the same target and one of those colleagues has a significant advantage due to better for equipment for example. This is a bit different but this would fall under more of a constructive dismissal type scenario rather then discrimination. |

I am not sure constructive dismissal would work because I'd be retiring so for all intent and purpose leaving anyway. However I'd like to stay but they won't allow this unless I don't retire. It'd be far cheaper to employ me at Staff level than officer level. It makes no sense.

Are you looking to retire and return? If so this is usually at the discretion of the manager depending on service need .if it is declined the manager should provide an appropriate rationale.

I think it's more to do with the fact that 1 area has followed the correct procedure whilst the other hasn't. I am trying to find out how best to challenge this and why they haven't followed the same procedure.

How do you know the other area has followed the correct procedure? It may be that the area you are in is correct and the other is wrong? Is every single aspect of the two roles the same, I think I remember that you were job share with someone else who is still intending to be serving so is the other role you are talking about exactly the same with one half intended to be civilian and the other not? If everything is absolutely comparable and the same then I would go back to what I said earlier and take it up with line manager first and if necessary use the grievance system.
Sadly it may come down to management discretion as some things do and not discrimination or unfair practices. I hope it all works out for you. |
