No they dont check for Estas when you book a flight. Many people book flights before they apply for an esta

My interpretation of the OPs post is that he will be coming back within the allowed 90 days - I think 'after 90 days' is just a turn of phrase to mean essentially on the 90th day (or close to this e.g. 89 days). For example, if you were going away for a fortnight, you may say to someone 'I'll be back after 2 weeks' meaning you'll be back once the 2 weeks have passed. But I can understand why others have interpreted as actually being post-90 days.

So his return flight is already booked as intimated earlier,then assuming he gets his new ESTA that should be good.

Personally, I wouldn't leave it until exactly 90 days has passed just in case flights are delayed/cancelled or there's some other issue. Although, in theory, as long as there aren't more than 90 days between when he arrives and when he leaves then he should be ok.

Yes, he should definitely plan to leave a few days before the 90 day limit for safety, in case his flight gets delayed/cancelled. An overstay is an overstay, they don't accept "my flight got delayed" as an excuse. If he goes past the 90 days, even a tiny bit by accident, he won't be able to travel on ESTA again and will have a harder time getting a visa.
Also, he should be prepared for scrutiny at immigration when entering. Staying close to the maximum permitted time and visiting his girlfriend will be red flags for them, so he should be ready to show them his return ticket, proof of funds to cover his costs in the US during that time, and proof of ties to the UK that he will return to. Yes assuming he finally gets esta approved and gets to go
Ill tell him about making sure he comes back a bit before the deadline to be sure and that he has all his proof ready He has a room he rents and a job to come back to He has a return flight booked and it’s movable

Glad someone else asked about this. Did ours yesterday and still say pending so was worried there was something wrong as they usually get approved within an hour or so. Hopefully they will be approved soon.
