Perhaps he could get in touch with the American Embassy again and let them know he now has the work documentation to prove he is coming back after the visit? Perhaps there is another Visa he might qualify for? There must be some sort of advice line or email address for a customer care advisor or similar

He has Asperger's and was getting quite anxious before he went so wasnt thinking straight Wish he d mentioned it to me

This situation does suck. But he shouldn't beat himself up too hard for applying for the new ESTA. If he'd flown to the US on the old ESTA, he very likely would have been refused entry with the visa denial on his record. And that would have been an absolutely miserable experience for him.
Having to fly there, get grilled by immigration, and go right home, and then if there wasn't a flight home available the same day, potentially having to spend the night in immigration detention or maybe even a county jail waiting for the return flight. So he at least saved himself that. ESTA is there in the first place is to avoid those sorts of situations. Edited at 06:47 PM. |

Yeah I said to him earlier when he was getting annoyed with himself that it probably would have flagged up in immigration anyway

What reason was he given for refusing his B2 visa application?
That’s really going to be the crux of whether he is going to be able to reapply or not (and have any chance of being accepted). Was he deemed temporarily ineligible, or was it a permanent ineligibility? Why did he apply for the B2 visa rather than travel on an ESTA? Was he wanting to stay longer than 90 days? |

He wanted to stay a bit longer as his girlfriend is American
He’s got a sabbatical from his uk job so was going for longer He got denied as weren’t enough ties to girlfriend to warrant it Denial letter said can reapply if circumstances change His gf came here for months with no issues at all 😂 Hated the uk though and doesn’t want to come back

His job has someone in to replace him on a temporary contract while he s away so he has no job to go back to yet

Does he have the funds to speak with an immigration specialist/lawyer?
They could help him gather and present the appropriate evidence and documentation to support his application. Sounds like his application was refused based on temporary ineligibility rather than permanent so he could have a positive outcome in the future - although it may be tricky for now. I imagine they thought he didn’t have enough ties/provide enough evidence to ensure he would definitely come back home. |
