I think that is correct. I would put in a formal claim anyway, and keep fighting them until they agree to it. They are trying to fob you off with a reason that isn't correct

I think you'll find they are wrong and you are entitled to compensation as it counts for when you arrive at your final destination and they are responsible for the delay unless it was outside their control (weather being one of them but technical or crew issues is not). Typical of the companies trying to deny it. There rebooking you on a different flight to get you home due to their issue is not an agreement to waiver your rights under the law and you should make a formal claim.

I travelled MCO-MAN-DUB a few years back on Virgin/Aer Lingus, left MCO just over an hour late, missed my Aer Lingus connection in Manchester. Virgin put us up in a day hotel in MAN and caught a flight later that day. Finally arrived 8 hours late. Put in a claim and got paid out.

Whilst this is true it still isn't clear whether EU261 would be relevant as Virgin would not be an EU registered carrier so EU261 would not (necessarily) apply.
I'm hoping some of this mess will get sorted before April 2019, but I'm not too confident that it will.

Even though your original flight was delayed less than 3 hours, it caused a misconnect on your ticket meaning you reached your final destination on the same ticket over 3 hours late, so you would be eligible for EU compensation. As others have said it depends on the reason for the delay/extraordinary circumstances etc and as to whether or not it was a delay or schedule change which was notified of in advance. It's strange that they've declined it if it was their fault, although they may have declined based on the original delay time and not realised/picked up on the fact that you had a connecting flight that you missed as a result, pushing your arrival delay over the 3hrs - that's happened to me in the past and it was quickly rectified once it was pointed out to them! Hope you get it sorted with them soon!

Think the person I was speaking to just thought that I was going to just leave it at that when they said I wasn’t entitled to claim. Hence asking in here. So I have submitted that form with the requested information. So hoping to hear back from them soon.

put a claim in - worse that can happen is they refuse to pay. If you want to because this maybe a battlle, use an agent - let them do the paperwork for you - they wont touch it if they think its a non runner. Way i see it, if you dont claim you will never know - if you dont want the hassle use an agent (there will be a fee, taken from your compensation) - but having go gives you a chance.
doing nothing gets you nothing. I had a similar issue years ago - but the claim was against my insurance - they argued that the flight departed on time and i wasnt entitled to insurance payout - i argued i was delayed fior over 24 hours as i arrived at my final destination over a day later than was planned and take off time was of no concern. They paid out but then changed the wording on future policy go for it IMHO Edited at 09:49 AM. |
