Don't Villa owners have their own terms and conditions though?

We lost our villa deposit. Insurance company would not pay out as they said it is pandemic and we are not covered. Insurance was taken out June 2019 annual travel insurance.

Yes they do and 99% of them will be that the deposit is non refundable.

Try AirBNB/HomeAway. They have better cancellation policies

The insurance company just rang to say that, as I’d cancelled more than 28 days before travel, they won’t be paying out on the claim! I’m annoyed as had I known I would have asked the owner to hold off the cancellation paperwork until 28 days before (She’d already said I could wait until 3 weeks before going to pay the balance due to the current situation). Just wanted to warn others in a similar situation
Tracyjjo this happened to me and I lost the appeal on the 28 rule, fortunately I only lost the deposit as the owner returned the rest. I am sure I put this on the DIBB I am sorry you missed it.

Is the 28 day thing to do with Foreign Office advice not to travel?

When we have booked villas privately they normally come with a set of terms and conditions we have had to agree to and mostly they include a non refundable deposit.

But that should only apply if it is the customers who wish to cancel. As Moorlandman says, if the villa owner is unable to provide the stay, then the contract is frustrated and they should issue a full refund.

The villa owner was able to provide the stay - it’s not their fault if the customer can’t get there.

Exactly this! I’m not blaming the villa owner, she’s been very helpful. I’m just kicking myself for not realising that if I’d waited until 28 days, before the rental was supposed to start, instead of cancelling 49 days before, my insurance company would’ve paid me my deposit back
