So long as the passport and his ticket match it's fine.

In no way am I doubting anyone’s knowledge on here, but surely it would be advisable to check somewhere official to see if he will need one or not because it’ll be too late if you find out it’s not valid when you’re trying to board an aeroplane

I would say as long as his ticket and esta is all matching it would be fine. When I got married I still have 5 years left on passport and I just travelled in my maiden name even tho my bank accounts and driving licence was in married name till my passport run out.

Just book the ticket in your passport name and do the Esta in the same name too.
It's still a valid passport, it's not cancelled or changed until you do it or it expires. |

personally if he has bank cards etc in his new name i would get passport to match
i have seen on this border control tv series where people carrying bank/credit cards in different names have been pulled in... same for insurance cover etc could potentially be an issue ? 99% probably not be an issue but for the sake of 70 quid? imo of course .. |

As far as I'm aware, so long as names match on all documentation, it should be fine. Plenty of people do this (including me!) When tbey get married. Their surname will have changed but passport still in maiden name.

To be absolutely fully compliant with the law then yes you do need to change your passport if you change your name for any reason as your passport should match your legal name.
But that's the letter of the law as per gov.uk/changing-passport-information and deedpoll.uk/ChangingY...rPassport.html As others have said, if your passport, ESTA and travel documents all match you will be unlikely to have any issues. I would make sure you have the deed poll document with you if you decide to travel on the existing passport. Its your choice as to which way you go. Does seem a pain to get a replacement childs passport when they are so close to getting and adult one. But thats not a legal reason not to. |
