as already said tickets are non transferable, signatures are required and Seaworld, IOA etc they are finger printed.
IMHO not worth the risk buying from anywhere other than an official seller, I know that doesn't help OP.
Can you not open a case from ebay and request refund?

He has proof that he posted them and that they are genuine tickets, we cant provide anything to say they are not valid unless we get disney to verify

Disney won't be the least bit sympathetic. They always tell you to buy either direct from them or from recognised sellers such as a bonded travel agent. As used (part) tickets are linked to a finger print of the original owner and are "not transferable" (see the T&Cs) the last place I'd buy Disney or any other park ticket tickets would be from Ebay.

They are brand new & unsigned...not sure if that makes a difference

A hard and expensive lesson for OP to learn.

I'm still not sure what you're asking, where are the tickets now? with you or seller?
If you've not rec'd goods why can you not claim refund through ebay?

I'm not trying to be harsh and I sympathise with your plight. The Dibb is here to give advice to all Dibbers so maybe a a pre question on here about whether to buy those tickets or not would have saved you some pain. But as I say, Disney won't want to know. Their magic doesn't extend that far.

Your recourse is with the seller. If you paid by Paypal the that's the way to go. Good Luck!

We have the tickets here, the seller posted them recorded delivery and then 2 days after they arrived said he needed them back as he hoped to use them later in the year. We said that he had taken our money and therefore the tickets were now ours, the seller then said that he had spoken to disney as he had cancelled his holiday with them they had voided the tickets and they were now unusuable.
We opened a case through paypal, the seller has provided evidence that the tickets are genuine and that he posted them. He said he would give us a refund but its never turned up, he said he had done it but its not showing on my ebay.
It all just seems really odd and confusing but in our current financial situation we cant really afford to delay!
