Probate has to be granted before any property can be sold, so it must have been done.

When dad died 5 years ago, solicitor took care of the probate for us, once we had the paperwork for that, I took Mum to the bank with all the documents and death certificate and the bank transferred the money straight away. It was in her account a couple of days later.

Didn’t realise the solicitor can pay a bit now and then more in the later months, especially when it’s “your” money he’s holding back

Thanks my thoughts exactly but as others have said they need to make sure debts are paid, but it’s still a lot of money to be keeping

A interim payment is usually made/offered if the final accounts aren't completely finalised but the solicitor is happy that there is sufficient money available that won't be subject to any claim.

It's not the beneficiaries money until all debts/claims are paid to the executors satisfaction.

I would be asking the solicitor what exactly is taking so long. Probate has been granted which is usually the most complex parts. If they have an inkling there are bills to be settled it’s perfectly reasonable to hold back something to cover those but they should be able to justify it.

If it’s simply the banks haven’t paid up then there really is no excuse. My experience is similar to others once banks have the docs they require usually the probate certificate, death certificate and Will in order to identify the executor then they usually hand the cash over within a week.From what you have said your cousin is named as an executor so could approach the banks specialist bereavement department themselves.

My dads probate was just money in the bank and we had a possible issue of the will being written 4 years before it was actually signed! His probate took 8 days! I know others have said not to be worried but I personally would be on the phone pretty much every day!

We done the probate ourselves - very easy, although we had to print it off the .gov website as we couldn't progress past a certain point doing it online .
It took about six weeks to get back all done.
The solicitor dealing with the house sale has given us all the paperwork for us to sign so money can be transferred as soon as house sale goes through.

Just spoke to my Hubbie’s cousin and she’s spoken to her Solicitor today, I think I spurred her on when I read her some of the Dibbers comments on Monday

He’s told her she should have the rest of the money in a week & it’s the Post Office that’s been the delay, this is where her state pension was paid.

She still doesn’t know what his charges are 😳🙁very silly should always get a price first & I’ve told her this many times.

They post office were the single worst to deal with with my Fathers estate - the amount of forms I had to sign in front of a witness was legendary . It took well over a year for them to pay out for me and I had to call (executor ) as did my lawyer weekly - they are totally useless and told me it should be through in 24 days - well it took over that in weeks (11 motnhs from benig sent probate) - they have a terrible reputation for dealing with probate estate according to my friends who have all, without exception, suffered same delaying delivery tactics from Post Office
