I’d be very interested to hear if you get anywhere with pursuing this. Bonkers that if you’d waited until you’d paid the balance, they would’ve paid out a lot more money. Using a technicality in these strange times, seems so unfair!
Well, it’s taken 9 months for the ombudsman to come back to me (they’re clearly very busy) but they agree with me that the insurance company have unfairly dismissed my lost deposit claim and they haven’t acted fairly given these unprecedented times. They’ve given the insurance company a week to come back to them with any new evidence refuting the claim.

I’m happy that the ombudsman agrees with me so we’ll see what the insurers have to say. I didn’t think it’d take so long though.

I’ll update again once I get a further update.

Well further to my last post, the insurers have paid up! They agreed with the ombudsman’s decision that they acted unfairly in dismissing my claim so finally, 10 months down the line I have my villa deposit back plus 20% interest. 😃

Not strictly true , Airbnb don’t have blanket conditions , different properties have different conditions ranging from non refundable to free cancellation up to the day before , you need to check property cancellation terms for individual properties .

Always nice to see a good result, and excellent that they have paid interest on it too.

Always sticks in my throat when a company hoards customers money and then gives it back with no interest, great to see that hasn't been the case here.

Excellent news, pleased for you but insurers should have paid in the first place.

Ombudsman got half of mine back plus £100 as an apology but I went back and asked them to get the rest in January, so maybe I will hear in another 3 months

Well done!

The 28 day rule is complete nonsense if the Foreign Office advice remains in place.

Even if the advice changed it could be very tricky to pick up all the travel arrangements again after your flight has been cancelled.

Edited at 04:32 PM.

Thanks all for your comments.

It’s a small win for the consumer and I’m glad I pursued it. They didn’t play fairly but I wonder how many people just accept their insurers decision to deny a claim and lose out on reclaiming money that is rightfully theirs
