Your contract was to rent this particular villa from the MC. They are no longer in a position to do this, but what they are obligated to do will be have to be inferred from the contract that that you have entered into.

Once you are sure if your position then you can approach the MC with an ultimatum, a hard date in the diary for the refund and then a promise of legal action to recover your money.

I would definitely agree with you that it would be time for legal action if the company was in the UK.

But the risk to the OP is that legal action will be more costly than the deposit. I read up on lodging a small claim in Florida the other day and it look s like it would require at least two visits or paying for legal representation for at least two meetings. Perhaps one of the next steps is to look into the process thoroughly and price up potential costs.

The villa owner left the MC due to the MC over money, MC withholding the owners money, owner chasing money etc (if only we knew before booking)
I am 99% sure he has took legal action, the villa was almost booked up for 2020 and plenty of bookings for 2021 so the owner is trying his best to keep his potential customers.
The MC would not give him the booking details, all rather nasty to be honest

It is robbery. My husband is very laid back and nothing bothers him but he is extremely angry about this.

Lawyers will often do a free 20 minute consultation. It may be worth finding someone who can point you in the right direction if legal action is needed.

There are laws about time limits on a deposit (15-60 days) but who cancelled may be the big question in regard to the return.
